NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 21, 2021, executed by Borrower(s), Matthew S. Brigman, to Old Republic National Title, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 845, at Page 94.  At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 327 W Pocahontas St, Rupert, WV 25984.  WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 23, 2026, of record in the Clerk’s Office.  The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust.  Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:

26th day of August, 2026 at 12:00 p.m.

All that certain lot, tract or parcel of land, together with the buildings thereon, and the easements, rights of way and appurtenances thereunto belonging, a tract of land in the Town of Rupert, Greenbrier County, West Virginia, at the north end of Sixth Street on the north side of Pocahontas Street, more particularly described as follows:

BEGINNING at a 3/4” rebar, found, on the north side of Pocahontas Street, a corner to Woodrow Yoakum; thence with Pocahontas Street, N 74-00 W 71.12 feet to a 3/4” rebar, found, a corner to William Simms; thence leaving Pocahontas Street and with Simms; N 15-59 E 125.02 feet to a 3/4” rebar found; thence N 74-12 W 100.04 feet to a 3/4” iron pipe, found; thence leaving Simms and through the Brackenrich property, N 73- 47-30 W 68.91 feet to a 3/4” rebar, found, a corner to Bobby Scruggs; thence with Scruggs, N 74-01 W 74.93 feet to a 3/4” rebar, found, on the James Alvis property line; thence leaving Scruggs and with Alvis, N 15-59 E 242.01 feet to a 3/4” rebar, found N 15- 59 E, 51.03 feet to a rebar, found, on the Thomas Puffenbarger property line; thence 3/4” leaving Alvis and with Puffenbarger, S 81-41-30 E 398.16 feet to a 3/4” iron pipe, found, a corner to Lonnie Hellems; thence leaving Puffenbarger and with Hellems, S 8-26-30 W 50.05 feet to a 3/4” rebar, found; thence S 14-26 W 213.11 feet to a 3/4” rebar, found; thence S 49-49 W 131.17 feet to a 3/4” rebar, found; thence S 39-27-30 W 25.03 feet to a 3/4” rebar, found, a corner to Woodrow Yoakum; thence leaving Hellems and with Yoakum, S 15-59-30 W 75-45 feet to the beginning and containing 3.06 acres, more or less, as surveyed by Harvey B. Neel, of Lewisburg, West Virginia in November 1997.

And being the same property conveyed unto Matthew Brigman, by deed of Dixie L. Wickline dated April 21, 2021, and recorded in the Office of the Clerk of Raleigh County Commission on April 28, 2021 in Deed Book 626, Page 442.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
