A Greenbrier County man was arrested on the evening of Sunday, Dec. 20, after allegedly assaulting a female victim.
James Carl Burr III, 64, of Pocahontas Trail in White Sulphur Springs, has been charged with second degree sexual assault.
At approximately 10:20 p.m. on the date in question, West Virginia State Troopers were dispatched to the Greenbrier Valley Medical Center in response to a sexual assault. The victim alleged that her employer, James Carl Burr III, committed the assault against her.
According to the criminal complaint, the victim provided troopers with a recorded statement, which outlined the details of the attack.
The victim stated that the assault occurred at Burr’s home from the hours of 3:30 p.m. until 5:00 p.m. The victim also states that Burr’s wife was home during the attack, and was yelling from a bedroom within the residence. The victim indicated that Burr’s wife suffers from a severe medical condition and is unable to get out of bed. The victim was sure of the time period, as a clock on the wall was visible for the duration of the attack.
The complaint states that, despite being repeatedly told “no”, “please stop” and “please don’t do this,” Burr proceeded to violate the victim in numerous ways.
Troopers obtained samples of Burr’s DNA, before executing a search warrant at his home at approximately 3:15 a.m. on Monday, Dec. 21. Troopers located Burr within his residence and arrested him without incident. At the time of his arrest, Burr was wearing the same clothes as he was wearing during the alleged attack. Troopers also identified blood, believed to be the victim’s, on Burr’s shirt and right hand.
Burr was then transported to the Lewisburg Detachment of the West Virginia State Police for processing. While at the Lewisburg Detachment, troopers conducted an interview with Burr.
According to the criminal complaint, at this time, Burr allegedly confessed to sexually assaulting the victim in the living room of his residence. Burr was arraigned by the Greenbrier County Magistrate on Tuesday, Dec. 22, and has been released on bail.
