On Oct. 19, a Pocahontas County jury found a Marlinton man not guilty of the crimes of murder and of use of a firearm during the commission of a felony. Jeremi L. Kincaid, 29 of Marlinton was indicted for the alleged crimes in July of 2021 following the November 27, 2020, shooting death of Gaylen L. Biggs, 48 of Pocahontas County.
According to a press release from Michael R. Whitt’s office, the case proceeded to trial over four days and ended with the not guilty verdict following slightly more than two hours of jury deliberations on Oct. 19. The case was dismissed, and the defendant was released from his bond. The jury specifically noted that the defendant had acted in self-defense in the shooting.
The defendant was represented by attorneys Whitt and Kristopher R. Faerber both of Greenbrier County. The state was represented by special prosecuting attorneys Patrick I. Via and Ryan R. Blake both of Greenbrier County. The case was presided over by Pocahontas County Circuit Judge Robert E. Richardson.
