NOTICE IS HEREBY GIVEN that an action has been instituted in the Circuit Court of Greenbrier County, West Virginia, bearing Civil Action No. 2026-C-20 upon the Complaint for Declaratory Judgment Plaintiff, U.S. Bank N.A., as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2006-EMX1 (“Plaintiff”) to reform the 2025 Deed, the DOT and the 2024 Deed to reflect the interest that Corey Sexton transferred to himself and his wife, Kimberly, Sexton, in 2005.
Plaintiff, by counsel, and for its Complaint for Declaratory Judgment against Defendants, Corey Sexton and Kimberly Sexton (“Defendants”) has brought forth this action for the purpose declaring the references in the 2005 Deed and 2024 Deed to an “undivided one-fifth [1/5] interest to avoid unjust enrichment by reason of a constructive or resulting trust; and order any such other relief as deemed proper by this Court.
A copy of the Complaint can be obtained from the Circuit Clerk of Greenbrier County, West Virginia and/or from Matthew Casto, Esq., or Tiffany M. Arbaugh, Esq., attorneys for Plaintiff, U.S. Bank N.A., as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2006-EMX, 1 located at 300 Summers Street, Truist Square, Suite 1000, Charleston, WV 25301. Defendants must respond to the Complaint and make yourself known to the Plaintiff on or before May 15, 2026, or action may be taken by the Court in accordance with the law.
