NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 10, 2019, executed by Borrower, Paula R Jackson, to David G. Hammond, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 808, at Page 226. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5709 Blue Sulphur Springs, Alderson, WV 24910. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 20, 2025, of record in the Clerk’s Office in Book 906, Page 551. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:
18th day of July, 2025 at 12:30 p.m.
All those certain lots, tracts, or parcels of land situate in West Virginia, described as follows: FIRST TRACT: BEGINNING at a concrete culvert near the Clay Vandall gate on line with party of the second part (sic; party not identified in description), and with road, S. 150 feet, more or less, to a sycamore; thence, a straight line northwest to a double walnut, corner to Earl L. Hiser property; thence, with Hiser to the BEGINNING, and containing 3/4 an acre, more or less. SECOND TRACT: BEGINNING at a concrete culvert near the Clay Vandall gate on the Blue Sulphur Road; thence in a straight line west to a Hack walnut on a steep hill; thence in a straight line north to a black walnut near a small hollow; thence in a straight line west to an elm on C.L. Hanson line; thence north with Hanson to J.E. Donahue line; thence northeast with Donahue to a Blue Sulphur road-thence south with said road to the point of BEGINNING, and containing 36 acres, more or less; less 26 acres and 43 poles conveyed by the said Earl L. Hiser and Audrey Hiser, his wife, to J.E. Donahue, by Deed dated February 20, 1952, of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 180, at page 164, leaving 9 acres and 117 poles in said tract herein described. THIRD TRACT: All of that certain tract of 0.18 acre, more or less, enclosed within a certain agreed boundary situate along West Virginia Route 25, situate in the Blue Sulphur Tax District, Greenbrier County, West Virginia, described as follows: BEGINNING at a 5/8” rebar and cap set, in a root wall of a double walnut, found, on a steep hillside in a fence line, corner to Andrew M. Edwards, II (DB 508, Pg 486), corner to Emily Hiser Thomas (DB 411, Pg 648); thence going through Edwards and down the hillside with the fence, S 71-25-51 E 165.334 feet to a 24” white oak; thence continuing through Edwards, S 39-44-37 (sic; missing directions) 43.07 feet to a 5/8” rebar, set, at the top of a creek bank, from which N 37 E 05 feet bears a 12’ buckeye; thence continuing through Edwards and crossing the creek with the fence, N 81-53-18 (sic; missing direction) 91.84 feet to a 5/8” rear, set on the western right of way of Rt. 25, from which N 15-18-15 W 36.69 feet bears a 5/8” rebar, set on the western right-of-way on Rt. 25 being an agreed boundary line, as surveyed in October, 2007, by Rickford Walton, W. Va LPS No. 856, of Leivasy, West Virginia. AND BEING the same lot, tract, or parcel of land conveyed unto Paula R. Jackson from Emmylou Woolfitt McDaniel, formerly known as Emmylou Woolfitt, by Deed dated April 15, 2019, said Deed to be recorded in the Clerk’s office.
TERMS OF SALE:
1. The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6. The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
