A Pocahontas County man was arrested on the evening of Monday, March 1, after being found passed out in his vehicle. Donald Paul Jordan, 39, of Marlinton, has been charged with one count of committing prohibited acts.
On the evening in question, Pocahontas County deputies were patrolling Route 28 in the Greenbank area, when they observed a vehicle in the parking lot of the Dollar General. The deputies pulled into the parking lot to investigate, as the store was closed for the night.
According to the criminal complaint, deputies discovered a man (later identified as Donald Paul Jordan) in the vehicle, slumped over the steering wheel. At this time, West Virginia State Troopers arrived on the scene to assist with the investigation and knocked on the driver’s window in an effort to awaken Jordan.
The complaint states that Jordan awoke “in a confused state of mind,” and had difficulty answering the officer’s questions. Jordan was also allegedly unaware that his vehicle was in drive prior to officers asking him to put it into park.
Jordan reportedly struggled to put down the driver-door window, prompting officers to order him out of the vehicle. Once the vehicle’s door was opened, officers claim to have detected “the odor of marijuana.” Officers also reportedly found a pistol in the driver’s door of Jordan’s vehicle. However, it was later confirmed to be a toy gun.
The complaint further states that Jordan admitted to having marijuana in the vehicle. Officers then performed a “probable cause” search, at which point they found six-separate bags containing “a large amount of a green leafy substance,” a digital scale and $847 in cash.
Donald Paul Jordan is currently being held at Tygart Valley Regional Jail on a $10,000 cash-bond or surety.
