The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated December 10, 2019, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed of Trust Book 817, at Page 746, Nicole K. Lewis and Nancy C. Brenem did convey unto Virginia A. Lemon, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse, in Lewisburg, West Virginia, on
October 2, 2024, at 8:30 AM
the following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the White Sulphur District, Greenbrier County, West Virginia, and more particularly described as follows:
The following described tract or parcel of real estate, together with any building and improvements thereon located, lying and being situate in White Sulphur District, Greenbrier County, West Virginia about 6.5 miles south of U.S. 60 on the southeast side of West Virginia State Local Service Route 50, more particularly bounded and described as follows:
Beginning at a 9” Sycamore, found on the southeast side of W. Va. S.L.S. Rte. 50, a corner to Victor Dunsmore, 69-03 E 253.62 feet to a 14” Poplar, found; thence, S 56-51 E 112.94 feet to a twin hemlock, found; thence leaving Dunsmore and through the Nester property, S 61-21 W 96.93 feet to a 8” White Oak; thence S 50-53 W 231.67 feet to a 10” Cedar; thence N 46-47 W 244.17 feet to a ¾” Iron Pipe, set, on the southeast side of W. Va. S.L.S. Rte. 50; thence with Rte. 50, N 39-39 E . 87.96 feet to the beginning and containing 1.76 acres, more or less, as surveyed by Greenbrier Surveying Co., Inc. of Lewisburg, West Virginia, in July, 1977, and as shown on a plat recorded in Deed Book 311, at Page 736.
TOGETHER WITH a right-of-way and easement fifteen feet (15’) in width for the purpose of providing pedestrian, vehicular, and utility access from Tuckahoe Road to and from the aforesaid real estate, which easement was conveyed to Almost Heaven Habitat for Humanity, Inc., from Lloyd Junior Feury, by Right-of-Way Deed dated October 9, 2018, of record in the aforesaid Clerk’s Office in Deed Book 603, at Page 487.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 7453 Tuckahoe Trail, White Sulphur Springs, WV 24986.
AND BEING the same real estate which was conveyed to Nicole K. Lewis, by Deed dated May 5, 2017, from Carol Louise Dunsmore, and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 590, at Page 389.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
