NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 17, 2005, executed by Borrower(s), Richard Johnston and Shannon Johnston, to Tommy J. Dixon, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 558, at Page 28. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1165 Fleshman Hollow Rd, Rainelle, WV 25962. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 8, 2026, of record in the Clerk’s Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:

All that certain property situated in the District of Meadow Bluff, County of Greenbrier and State of West Virginia, containing 4.00 acres, more or less, being more fully described in a Deed Volume 473 and Page 970, Map #69, Parcel #54.1 and Tax ID# 19553.
All of that certain tract or parcel of land situate in Meadow Bluff District, Greenbrier County, West Virginia, together with the improvements thereon and appurtenances thereunto and belonging, more particularly described as follows, to-wit:
BEGINNING at a 42 inch diameter Oak tree on the western right-of-way line of West Virginia County Route 20/2 (paved/public right-of-way,) the southeast boundary corner of Parcel 55, Tax Map 69 (Mary Odell Phipps, Deed book 178, Page 552;) thence with a tie line, South 40° 48` 59” West, 251.78 feet to a 5/8 inch diameter iron rebar (placed,) the point of BEGINNING, a point on the western right-of-way line of said West Virginia County Route 20/2; thence following the wester right-of-way line of said West Virginia County Route 20/2 the following six (6) bearings and distances: 1) South 56° 25` 37” West, 50.00 feet to a point, 2) South 44° 37` 52” West, 48.58 feet to a point, 3) South 39° 45` 15” West, 98.11 feet to a point, 4) South 58° 38` 26” West, 100.00 feet to a point, 5) South 62° 05` 28” West, 100.00 feet to a point, 6) South 55° 52` 36” West, 98.84 feet to a 28 inch diameter Oak tree; thence leaving the wester right-of-way line of said West Virginia County Route 20/2, and following new boundary lines creating a new subdivision of land out of Parcel 54, Tax Map 69 (Ida R. Harris, Deed Book 4429, Page 648) the following three (3) bearings and distances: 1) North 49° 09` 38” West, 474.28 feet to a 5/8 inch diameter iron rebar (placed,) 2) North 71° 44` 55” East, 458.51 feet to a 5/8 inch diameter iron rebar (placed,) 3) South 65° 12` 54” East, 370.84 feet to the point of BEGINNING, containing 4.00 acres more or less as shown on a drawing entitled, “Boundary Survey for: Roger Birchfield,” Project Number 02S-021, dated March 15, 2002, revised March 20, 2002, prepared by Jones & Jordan Engineering, Inc., Beckley, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
