GENERAL WV/NPDES WATER POLLUTION CONTROL PERMIT

WASTEWATER DISCHARGES FROM SEWAGE TREATMENT AND DISPOSAL

SYSTEMS OF DOMESTIC SEWAGE ONLY (50,000 GPD or Less, except mine bathhouses)

WV/NPDES PERMIT NO. WV0103110

The Division of Water and Waste Management is proposing to issue a General WV/NPDES Water Pollution Control Permit to regulate the discharge of wastewater from Sewage Treatment and Disposal Systems of Domestic Sewage Only (50,000 GPD or Less, except mine bathhouses). The General Permit will authorize the operation and maintenance of establishments engaged in Sewage Treatment and Disposal Systems of Domestic Sewage Only (50,000 GPD or Less, except mine bathhouses) and to cover the discharge of treated sewage to waters of the State. It is proposed that this General Permit be issued for a five (5) year term. The majority of the facilities to be permitted under this General Permit are already in existence, with approximately 3-5 new facilities every year.

In accordance with 60 CSR 5.6.c., Tier 2 antidegradation reviews are not required for these facilities. Coverage under this general permit will require the utilization of minimum treatment technologies that should result in an overall benefit to public health and the welfare of the environment from an improvement in water quality.

All facilities wishing to be covered under this General permit will be required to submit a facility registration application form. Upon receipt of the registration application form, the Division of Water & Waste Management will review it for completeness. The Division of Water & Waste Management then will advise the applicant of its coverage under this permit.

There are approximately 678 treatment facilities currently registered under the present general permit. If those facilities wish to continue discharging, they will be required to register for coverage under the new general permit.

The Director of the Division of Water and Waste Management retains authority to require any owner/operator to apply for and obtain an individual WV/NPDES Permit. This authority will be exercised when the Director determines that such individual permit will better protect the receiving water.

The Draft Permit and Fact Sheet may be inspected by appointment between 8:00 a.m. and 4:00 p.m., Monday through Friday at the Department of Environmental Protection, Division of Water and Waste Management, Public Information Office, 601 57th Street SE, Charleston,WV 25304. Copies of the documents may be obtained from the Division at a nominal cost.

Any interested persons may submit written comments on the Draft Permit. Comments will be accepted until August 18, 2025. They should be addressed to:

All comments received within this period will be considered prior to acting on the Draft Permit. Correspondence should include the name, address, and telephone number of the writer and a concise statement of the nature of the issues being raised. The Director shall hold a public hearing whenever a finding is made, based on requests, that there is a significant degree of public interest on issues relevant to the draft General Permit. Interested persons may contact the Public Information Office to obtain further information.
