The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 28, 2007, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed of Trust Book 615, at Page 218, Richard D. McKinney and Lorri A. McKinney did convey unto Richard A. Pill, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse, in Lewisburg, West Virginia, on
January 9, 2025, at 5:17 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Falling Spring District, Greenbrier County, West Virginia, and more particularly described as follows:
All of that certain tract or parcel of real estate, together with the improvements thereon and the easements and appurtenances thereunto belonging, situate, lying and being in Falling Spring District, Greenbrier County, West Virginia, more particularly bounded and described as follows:
“Situate in Falling Spring District, Greenbrier County, West Virginia, on the watershed of Laurel Run, about 1.6 miles northeast of the village of Auto and on the southeast side of State Local Service Route 11 and more particularly bounded and described as follows:
BEGINNING at a ¾ inch iron pipe set on the southeast side of and about 15 feet from the center of State Local Service Route 11 and from which a line bears S. 72-48 W. 249.75 feet to a Vepco transformer pole #RJ61; thence with the southeast side of the road, N. 72-10 E. 407.15 feet to a point 15 feet from the center of the road; thence continuing with the southeast side of the road and 15 feet from the center thereof, N. 62-43 E. 70.28 feet to a point; thence N. 49-33 E. 151.05 feet to a ½ inch re-bar found on a corner of Danny W. Dalton and from which a line bears S. 66-04 W. 173.76 feet to a Vepco transformer pole #SJ89 and a line bears S. 87-40 E. 53.59 feet to the northwest corner of the Dalton house; thence leaving Dalton and the road and through the property of Floyd Workman, Jr. S. 12-42 E. 509.69 feet to a double 8 inch cedar tree; thence continuing through the Workman tract, S. 57-54 W. 308.82 feet to a ¾ inch iron pipe, set; thence N. 45-37 W. 581.15 feet to the BEGINNING and containing 5.20 acres, as surveyed by Greenbrier Surveying Company in September, 1990, and shown on a plat attached to a certain deed by and between William W. Belcher and Mary T. Belcher, his wife, and Lucille Workman, Widow, dated the 8th day of January, 1991, recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book No. 404, at page 899.”
And being the same property acquired by Richard D. McKinney and Lorri D. McKinney by deed dated August 27, 2007 from Anthony Jones and William Jones, to be recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of HC Slab Camp Road, P.O. Box 297 A, a/k/a 1730 Slab Camp Road, Renick, WV 24966.
AND BEING the same real estate which was conveyed to Richard D. McKinney and Lorri A. McKinney, by Deed dated August 27, 2007, from Anthony Jones and William Jones, and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 515, at Page 566.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
