NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 20, 2020, executed by Borrower(s), Joshua D Hefner, to Virginia A. Lemon, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 822, at Page 336. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 4315 Seneca Trl S, Ronceverte, WV 24970. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 7, 2024, of record in the Clerk’s Office in Book 898, Page 421. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:
6th day of December, 2024 at 12:00 p.m.
All of that certain lot, tract or parcel of land, together with the buildings thereon, and the easements, rights of way and appurtenances thereunto belonging, being a parcel of land situate in Irish Corner District, Greenbrier County, West Virginia, and being more particularly bounded and described as follows: Beginning at a ¾” iron pipe set in the western right of way of U. S. Route 219, a corner to James D. Lassiter; thence leaving Lassiter and with said right of way S34-47-41 W 85.44 feet to a ¾” iron pipe set; thence with a curve to the left on a chord of S 25-04-31 W 200.72 feet to a ¾” iron pipe set, a corner to John C. Eades; thence leaving Route 219 and with said Eades N45-24-18 W 84.12 feet to a ¾” iron pipe found; thence N 21-20-41 E 48.37 feet to a ¾” iron pipe found; thence N 53-25-29 W 285.96 feet to a ½” iron pipe found; thence N 34-47-00 E 215.27 feet to a ¾” iron pipe found in the southern boundary line of James D. Lassiter; thence leaving Eades and with said Lassiter S 54-50-03 E 346.13 feet to the place of BEGINNING, and containing 1.88 acres, more or less, according to a survey made by N. Eugene Kelley on April 3, 1985. THERE IS RESERVED a 20’ right of way over existing gravel drive as recorded in Deed Book 314 at page 228. The aforesaid real estate is the same as that conveyed to Joshua D. Hefner and Angela D. Hefner, husband and wife, or the survivor, from Rebecca J. Sarver, by deed dated May 1, 2017, said deed is of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 590 at page 573. The interest of Angela D. Hefner, now Angela Persinger, was conveyed to Joshua D. Hefner by deed dated March 11, 2020, said deed not yet of record, but to be recorded in the aforesaid Clerk’s office prior to or simultaneously herewith. Reference is hereby made to all prior instruments in the chain of title for all right of ways, easements, reservations, restrictions, limitations and easements and right of way affecting the property herein conveyed. For Purposes of West Virginia Code §38-1-4, any notice of Trustee’s sale shall be mailed to the Grantor at the following address (or such address subsequently given to Lender in writing by the Grantor): 4315 Seneca Trl S, Ronceverte, WV 24970.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
