Governor Morrisey Applauds Passage of Trump Tax Cut Conformity into West Virginia Code

Charleston, W.Va. (WVDN) – Governor Patrick Morrisey applauded the passage of Senate Bills 393 and 400, which conform West Virginia’s tax code to the permanent provisions in the Trump Tax Cuts.

“President Trump delivered meaningful tax relief to the American people that reward work, encourage investment, and strengthen our economy,” said Governor Morrisey. “By aligning our state code with the permanent changes in the Trump Tax Cuts, we ensure that West Virginians receive the full benefit of those cuts right here at home.”

The Trump Tax Cut conformity legislation benefits businesses and families by:

  • Restoring 100 percent bonus depreciation for property and equipment purchases 

  • Reinstating full expensing for domestic research and development (including software)

  • Allowing for charitable deductions of up to $1,000 for single filers and $2,000 for joint filers

The plan also expands the business interest deduction and increases small business investment expensing to $2.5 million. At the same time, families will see a boost in support through an increase in the Child and Dependent Care Credit to as much as 50% starting in 2026 and an increase in Flexible Spending Account limits for childcare from $5,000 to $7,500 for joint filers.

“Conformity is important, but we still have work to do. The people of West Virginia are expecting relief, they’re expecting an answer to the affordability crisis, and they’re looking to us for the solution. That’s why we must pass an across-the-board income tax cut. The citizens of West Virginia deserve this,” Governor Morrisey said.
