NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 6, 2018, executed by Borrower(s), Patrick Murphy, to David G. Hammond, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 792, at Page 727. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 172 Old White Dr, Lewisburg, WV 24901. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 20, 2025, and recorded in Book 913, at Page 93 in the office of the Clerk of the County Commission of Greenbrier County, West Virginia. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:
17th day of March, 2026, at 12:00 P.M.
All of that certain tract or parcel of land situate in City of Lewisburg, Greenbrier County, West Virginia, together with the easements and appurtenances thereunto belonging, which real estate and easement are more particularly described as follows:
All of that certain tract or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, situate in Lewisburg Municipality, Greenbrier County, West Virginia and more particularly bounded and described as Lot 3 of Greenbrier Pines Subdivision, Phase I, as shown upon a map or plat of said subdivision of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Map Book 4 at Page A78.
SUBJECT TO, however, those certain covenants and restrictions as more fully set forth in the Declaration of Covenants, Conditions, Restrictions, Easements and Agreements for Greenbrier Pines Subdivision, recorded in the aforesaid Clerk`s Office in Deed Book 421 at Page 599, and as thereafter amended by instrument dated June 13, 1994, recorded in the aforesaid Clerk`s Office in Deed Book 424 at Page 610.
TOGETHER with all the tenements, hereditaments, and appurtenances thereunto belonging in or in any way appertaining, including membership in The Greenbrier Pines Homeowners Association, Ltd., a West Virginia corporation, and the privileges, rights, duties and responsibilities attendant thereto, as more fully set forth in the Agreement of Incorporation as said Corporation, recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Certificate of Incorporation Record Book 18 at Page 300 and the By-Laws of said Corporation.
The aforesaid real estate is the same as that conveyed unto Patrick L. Murphy, by deed dated March 15, 2018, from Michael Quick and Valorie Quick, husband and wife, recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 597, Pg 612.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) Pursuant to the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements.
7) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
