ALDERSON W.Va. (WVDN) – According to a criminal complaint, on Nov. 5, officers responded to a domestic in the vicinity of Alderson. Greenbrier County Dispatch advised the officers that the accused, later identified as Regina Smith, had allegedly knocked out the window of the residence with a rake. Officers were also told that the exchange with the accused had been physical.
When the officers arrived at the residence, they made contact with the accused. Smith was sitting in front of a camper. The officers frisked Smith for weapons and began questioning her about the events of the night. Officers asked Smith where her boyfriend was, and she reportedly said inside.
The officer then spoke with the victim. According to the criminal complaint, when the officer asked the victim what had happened, he responded by saying it was nothing but an argument, and he wanted to be left alone. The officer then ran the victim’s information, and he showed the officer where Smith allegedly knocked the window out with a rake after he locked her out of the camper.
Two officers then spoke with Smith. They inquired if the victim had tried to hurt her, and she responded by saying he had not. Smith was then asked if she threatened the victim, to which she reportedly responded, “Ummm, smacked him earlier, and I did threaten him with the stick I used to break out the window.“ The complaint also states that Smith said she hit him three hours before the call. The officers asked Smith if she was outside the door when she was threatening the victim, and she reportedly said she was.
The officer then went to talk to the victim again. The victim was asked if Smith had slapped him because she said she had. In the criminal complaint, the officer noted that when the victim heard this, he used body language that, according to training, the officer believed he wasn’t telling the whole truth. The victim kept saying he hadn’t been hit.
Dispatch advised the officer that the victim had an active warrant for failure to appear. After speaking with the other officers, he advised them that the victim was going to be under arrest, as well as Smith.
The officer then spoke to the victim and advised him that he was under arrest, and then advised another officer to keep Smith away from the victim until she was in handcuffs. Another officer was advising Smith of her domestic violence rights. The officer then placed her in handcuffs, and she was placed in a cruiser. Another officer walked the victim over, and he was asked if he wanted to file a domestic violence petition. He said he didn’t. Both parties refused EMS. Both parties were transported to Southern Regional Jail.
