The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 18, 2008, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 60921, in Book No. 642, at Page 58, Robert J Miller did convey unto Thomas V. Pennington, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCF2 ACQUISITION TRUST to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 17 – White Sulphur Corp District, Greenbrier County, West Virginia, and more particularly described as follows:
All that certain lot, tract or parcel of land, together with the buildings thereon, and the easements, rights of way and appurtenances thereunto belonging, situate in the White Sulphur Municipal District, Greenbrier County, West Virginia, and more particularly described as follows:
BEING that certain tract of land, together with the buildings and improvements thereon, easements, rights of way and the appurtenances thereunto belonging, located in the City of White Sulphur Springs, Greenbrier County, West Virginia, according to survey made on May 29, 1986, by N. Eugene Kelley, L.L.S., and as shown on the plat which is attached to that certain deed of record in Deed Book 374, at Page 220, and being more particularly described as follows:
BEGINNING at a fence post in the eastern right of way line of West Virginia S.L.S. Route No. 36 (Big Draft Road), a corner to Richard Cross; thence leaving the road and with Cross S. 25 57’ 03” E. 42.69 feet to a fence post; thence S. 56 35’ 56” E. 283.14 feet to a ¾” iron pipe found in the western boundary line of Jessie Ray Ellison; thence leaving Gross and with Ellison S. 34 47’ 12” W. 174.21 feet to a 3/4” iron pipe set, a corner to Richard Cross; thence leaving Ellison and with Cross N. 70 56’ 15” W. 174.65 feet to a ¾” iron pipe set in the eastern boundary line of Kenneth T. Gillespie; thence leaving Cross and with Gillespie, N. 23 31’ 56” E. 31.50 feet to a ¾” iron pipe set in the southern boundary line of Richard Thayer; thence leaving Gillespie and with Thayer S. 68 28’ 04” E. 22.00 feet to a 3/4” iron pipe set; thence continuing with Thayer N. 23 26’ 53” E 60.00 feet to a ¾” iron pipe set; thence N. 68 28’ 04” W. 125.00 feet to a ¾” iron pipe set in the eastern right of way line of West Virginia S.L.S Route No. 36; thence leaving Thayer and with the road, N. 23 26’ 53” E. 172.83 feet to the place of BEGINNING, containing 1.173 acres, more or less, together with an easement for a water pipeline form the aforesaid real estate to Big Draft Road and subject to the right of way of Richard Thayer, his heirs and assigns (formerly Virginia Martin) to the joint use of joint use of a driveway from Big Draft Road along a portion of the southern line of the hereinbefore described real estate.
And being the same real property conveyed unto Robert J. Miller, by deed dated November 4, 2004, from Mark J. Linkous, and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 493, at Page 741.
There is excepted and reserved from the above described property all that certain tract or parcel of land described as containing 7508 square feet along with a 10’ right of way, and being the same property conveyed unto Mark Foley, by deed dated August 18, 1997, and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 446, at Page 161.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 665 Big Draft Road, White Sulphur Springs, WV 24986.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
