All of that certain lot, tract or parcel of land together with the buildings thereon, and the easements, rights of way and appurtenances thereunto belonging, situate in Anthony Creek District, Greenbrier County, West Virginia, and more particularly bounded and described as follows:
Beginning at a ½” diameter iron pipe found along the northern right of way line of West Virginia State Route #92, corner to Lowell D. O’Dell (Tax Map 35E, Par 4; (D.B. 462, P.G. 126) and corner to James Strawn (Tax Map 35E, Par 2; (D.B. 499, Pg 728); Thence with said O’Dell tract along Route #92, N 59 51’ 25” E, 136.64’ to a point which is corner to said O’Dell tract and Jennings tract (Tax Map 35E, Tract 3, D. B. 490, Pg. 216) and is the true Place of Beginning; Thence leaving said Route #92 with the said O’Dell tract, N 28 12’ 28” W, 182.91’ to a point on the edge of Anthony Creek, passing a ½” pipe found @ +119.18’; Thence following the edge of said Anthony Creek; with the said Strawn tract for the next (2) courses; N 68 49’ 17” E, 150.99’ to a point; Thence N 75 06’12” E, 68.07’ to a point, corner to McDonald Smith, III (Tax Map 35E, Par. 7; D.B. 289, Pg. 462); Thence along said Smith tract, S 27 17 27” E, 141.74’ to a 2” iron pipe found on said northern right of way line of Route #92, passing a 2” Iron pipe found @ +25.2’; Thence with said Route #92, S 59 54’ 19” W, 213.94’ to the place of beginning, passing (2) iron bars found @ +171.6’, and containing 0.81 acres, more or less as surveyed by Terradon Corporation in October, 2006.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 14167 Pocahontas Tri, White Sulphur Springs, WV 24986.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
