NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 16, 2018, executed by Borrower(s), Justin H Campbell and Sasha B. Petroff, to David G. Hammond, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 792, at Page 68. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3684 Teaberry Rd, Ronceverte, WV 24970. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 12, 2024. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:
29th day of January 2025 at 11:00a.m.
All of that certain tract or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Ronceverte, Greenbrier County, West Virginia and more particularly described as follows: BEGINNING at a 1” iron pipe found in the northwestern R/W of W.Va. S.L.S. Rte. No. 45, a corner to Helen T. Green; thence leaving Rte. 45 and with said Green N 34°55’31” W 88.91 feet to a fence post found witnessed by a 1” iron pipe; thence continuing with said Green in part and through the property of Charles Patrick Brown in part N 53°39’49” E 179.12 feet to a 3/4” iron pipe set; thence continuing through said Brown S 47°40’50” E 80.17 feet to a 3/4” iron pipe set in the northwestern R/W of W.Va. S.L.S. Rte No. 45; thence with the meanders of said R/W S 38°02’02” W 16.49 feet; thence S 48°26’58” W 43.15 feet; thence S 54°03’10” W 63.13 feet; thence S 51°52’35” W 75.15 feet to the place of BEGINNING and containing 0.374 acre, more or less, according to a survey made by N. Eugene Kelley on January 27, 1993 and shown on plat entitled “Plat Showing the Property of David L. and Michelle Canterbury”. And being the same real property conveyed unto Justin H Campbell and Sasha B Petroff, by deed dated January 22, 2018, from Melissa Krystynak, and recorded in Deed Book 597, at Page 201. Reference is hereby made to all prior instruments in the chain of title for all reservations, restrictions, limitations and easements and right of way affecting the property herein conveyed. For Purposes of West Virginia Code §38-1-4, any notice of Trustee’s sale shall be mailed to the Grantor at the following address (or such address subsequently given to Lender in writing by the Grantor): 3684 Teaberry Rd, Ronceverte, WV 24970.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
