The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 16, 2010, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 82954, in Book No. 676, at Page 221, and modified by Corrective Affidavit recorded in Document No. 318806, in Book No. 667, at Page 563, Charlotte F Fox did convey unto Ed Goldberg, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by GITSIT Solutions, LLC, not in its individual capacity but solely in its capacity as Separate Trustee of GITSIT Mortgage Loan Trust BBPLC1 to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Lewisburg District, Greenbrier County, West Virginia, and more particularly described as follows:
Situate in the County of Greenbrier, State of West Virginia:
Lot 0 in the Green Acres Subdivision, together with the improvements thereon and privileges, easements and appurtenances thereunto belonging, situate, lying and being in Lewisburg Tax District, Central Magisterial District, Greenbrier County, West Virginia, on the west side of U. S. Route 219 about two miles north of the city of Lewisburg, as shown upon a map or plat of said Subdivision of record in the Clerk’s Office of the County Commission of Greenbrier County, West Virginia, in Map Book 3 at page 102.
There is excepted and reserved from the aforesaid conveyance a 14-foot strip of land adjacent to and adjoining Lot N. in said subdivision, as conveyed to Delmos E. Smith and Ann K. Smith, husband and wife, by deed of John Bransford, and others, dated November 7, 1973, and of record in the aforesaid Clerk’s office in Deed Book No. 283 at page 270.
The real estate conveyed by this instrument shall be subject to the following restrictions:
(1) No dwelling shall be built nearer the street than thirty-five (35) feet from the street line thereof.
(2) No dwelling constructed on any lot shall contain less than nine hundred (900) square feet of floor space, exclusive of garage, porches, patios, breezeways etc.
(3) No noxious or offensive operation shall be allowed or maintained on any lot, and nothing shall be permitted which may constitute a nuisance or unreasonable annoyance to the neighborhood, or which in any way tends to depress the value of property in said Subdivision.
(4) No part of the real estate hereby conveyed shall be used for the sale of beer, wine or liquor for a period of fifty (50) years from July 1, 1971.
(5) There shall be no concrete, cement, cinder block, asbestos shingles, trailers or out-buildings other than garage or attached carport or small storage buildings situate on said lots.
(6) The present sewage system upon the lot hereinbefore conveyed may no longer be used if and when a public sewage system is made available for said subdivision, and all sewage lines on said lot hereinbefore conveyed must be connected to said public sewage system within a reasonable time after the same is made available to said subdivision.
THIS CONVEYANCE IS FURTHER MADE SUBJECT to such easements, rights-of-way, reservations and agreements as are contained and set forth in prior deeds of conveyance pertaining to the said real estate.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 38 Green Acres Drive, Lewisburg, WV 24901.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
