RUPERT, W.Va. (WVDN) – A Greenbrier County man is behind bars without bail after allegedly fleeing from police on a motorcycle resulting in the death of his passenger.
Jimmy Lynn Rush, 27, was arrested on Thursday, June 8, after being indicted in Greenbrier County Circuit the same day in the incident. According to the indictment, on May 23, Rush fled from Rupert Police Chief C. L. Burkhamer on a 1998 Suzuki motorcycle. Cassandra Spencer was riding on the back of the motorcycle.
Rush fled from the officer through the town of Rupert, continuing eastbound on Route 60, reaching speeds in excess of 100 miles per hour, the indictment says, “showing a reckless indifference to the safety of others … and in so doing, caused the death of Cassandra Gayle Spencer.”
The indictment also states that Rush was under the influence of methamphetamine and heroin at the time of the incident, stating that he wrecked the motorcycle, resulting in Spencer’s death.
Rush is being held without bond at Southern Regional Jail. He is charged with felony reckless fleeing from an officer, felony fleeing from an officer causing death and felony driving while in an impaired state causing death.
