NOTICE OF TRUSTEE’S SALE

By virtue of the authority vested in him by that certain Deed of Trust executed by REYNOLDS OIL COMPANY, INCORPORATED, dated May 17, 2007, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed of Trust Book 607, page 842 said Deed of Trust and underlying Promissory Note dated May 17, 2007, being presently in default, the said Trustees, JAMES R. SHEATSLEY & AMY VICKERS FRITZ, jointly and severally, (either of whom may act), named in that certain appointment of Successor Trustees of record in said Clerk’s Office at Trust Book 920, page 632 having been requested by the beneficiary thereof so to do I, JAMES R. SHEATSLEY, undersigned, Trustee as aforesaid, will proceed to sell the hereafter described real estate at public auction on the 27th day of May, 2026, at the hour of 11:00 a.m., to the highest bidder for cash in hand at the front door of the Courthouse of Greenbrier County, West Virginia, which real estate is located at Sam Black Church in Meadow Bluff District, Greenbrier County, West Virginia, and is more particularly described as follows:

BEGINNING at a concrete monument at the intersection of the easterly right-of-way line of Relocated U.S. Route 60 Northbound with the southerly right-of-way line of Relocated W. Va. Secondary Route No. 60/4, said beginning point also being located 65 feet right of and at right angles to centerline station 38+50 of said Relocated W. Va. Secondary Route No. 60/4, thence leaving said beginning point and running with said southerly right-of-way line of said Relocated Route 60/4 N. 56° 01’ E. a distance of 164.99 feet to a concrete monument; thence leaving said southerly right-of-way line and running S. 9° 04’ E. a distance of 293.15 feet to a concrete monument; thence running S. 80° 24’ W. a distance of 140.86 feet to a concrete monument in the easterly controlled access right-of-way line of Relocated U.S. Route No. 60 Northbound; thence running with said controlled access right-of-way line N. 180 201 W. a distance of 54.51 feet to a concrete monument located at the terminus of the said controlled access right-of-way located 1046 feet left of centerline station 1785+81 Eastbound as shown on the map of Project I-64-4 (27) 145 of the West Virginia State Department of Highways; thence leaving said controlled access right-of-way line and running with the easterly non-controlled access right-of-way line of said Relocated U.S. Route No. 60 N. 90 041 W. a distance of 171.17 feet to the place of beginning, containing Thirty-Eight Thousand Five Hundred Thirty-Four Square feet and Thirty-Five One Hundredths of another square foot, (38,534.35 square feet); more or less.

And being the same property conveyed unto Reynolds Oil Company, Incorporated by Deed dated the 16th day of April, 1993, by Exxon Corporation, which deed is of record in said Clerk’s office at Book 418, page 204.

THIS SALE IS MADE subject to such easements, rights of way, restrictive covenants, reservations and agreements as are contained and set forth in prior deeds of conveyance pertaining to said real estate as well as real property taxes for 2026.

SAID SALE SHALL BE SUBJECT TO THE FOLLOWING CONDITIONS:

1) 10% cash in hand on day of sale with remainder due within 30 days.

2) Subject to any and all mineral rights and reservations, stipulations, restrictions, reservations, easements, conditions and covenants appearing of record in the aforesaid Clerk’s Office except any pertaining to race, color or creed.

3) Subject to all real estate taxes against said property and any taxes which constitute a lien upon the said property but which are not yet due and payable.

4) The property will be conveyed by the undersigned Trustee to the purchaser without warranty of any kind, expressed or implied.

5) The aforesaid sale may be adjourned from time to time as the undersigned Trustee deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof.

6) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

7) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

8) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

9) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

10) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

11) Pursuant to the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to deferral reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements.
